Extending the deadline for payment of VAT, CIT, PIT and land rental fee in 2023

The Vietnam Government has recently issued Decree No. 12/2023/ND-CP on extending the deadline for payment of Value Added Tax (“VAT”), Corporate Income Tax (“CIT”), Personal Income Tax (“PIT”), and land rental fee in 2023.  The decree came into effect on 14 Apr 2023 and shall expire on 01 January 2023.

The Decree is providing regulations on the applicable subjects, extension time, applicable period, and extension procedure as follows:

Extension for payment of VAT liabilities for tax periods from Mar to Aug 2023, and for tax periods of Quarter I, and Quarter II 2023 of the enterprises, and organizations mentioned as in Article 3, Decree 12/2023/ND-CP;

The deadline for payment of monthly/quarterly VAT liabilities is extended below:

(*) Note that the above regulation is not applicable to VAT payment at the import stage.

Extension for payment of provisional CIT liabilities for tax periods of Quarter I and Quarter II, 2023 of the enterprises, and organizations mentioned at in Article 3, Decree 12/2023/ND-CP. The extension is 3 months from the CIT payment deadline as prescribed by the tax administration law.

Extension for payment of VAT and PIT for payable tax amounts arising in 2023 of business households and individuals operating in the economic sectors and fields mentioned in Clauses 1, 2 and 2. 3 Article 3 Decree 12/2023/ND-CP;

Extension for land rental fee: The deadline for payment of 50% of rental fees for the year 2023 of enterprises, organizations, business households, or individuals directly leasing land from the State, under a Decision or Contract made by a competent regulatory authority, in the form of annual rental payment shall be extended with the duration of 6-month from 31 May to 30 Nov 2023.
