1. Do FDI enterprises need electronic identification from July 1, 2025?

Pursuant to Article 40 of Decree 69/2024/ND-CP, the effective date of electronic identification is as follows:

Effective date

  1. This Decree takes effect from July 1, 2024.
  2. Decree No. 59/2022/ND-CP dated September 5, 2022 of the Government regulating electronic identification and authentication ceases to be effective from the effective date of this Decree.
  3. 3. Accounts created by the National Public Service Portal, the information system for handling administrative procedures at the ministerial and provincial levels issued to individuals shall be used until June 30, 2024.
  4.  Accounts created by the National Public Service Portal, the information system for handling administrative procedures at the ministerial and provincial levels issued to agencies and organizations shall be used until June 30, 2025.

  5. Electronic identification accounts and certificates of eligibility for electronic authentication service business issued in accordance with the provisions of Decree No. 59/2022/ND-CP dated September 5, 2022 on electronic identification and authentication shall remain valid until the end of the prescribed period.
  6. For citizens who have had a level 02 electronic identification account before the effective date of this Decree, the identification management agency of the Ministry of Public Security is responsible for creating and displaying electronic identification for citizens through the National Identification Application from July 1, 2024.

Accordingly, accounts created by the National Public Service Portal, the information system for handling administrative procedures at the ministerial and provincial levels issued to enterprises can only be used until June 30, 2025.

At the same time, pursuant to Article 12 of Decree 69/2024/ND-CP stipulating the order and procedures for granting electronic identification accounts to agencies and organizations, from July 1, 2025, accounts that enterprises have registered on the National Public Service Portal, the information system for handling administrative procedures at the ministerial and provincial levels issued to enterprises will no longer be used and will start using electronic identification accounts on VNeID to access the National Public Service Portal, the information system for handling administrative procedures at all levels to handle administrative procedures according to regulations.

Thus, foreign investment vietnam enterprises must carry out electronic identification before July 1, 2025 to avoid legal risks when carrying out necessary administrative procedures.

In addition, to carry out identification for FDI enterprises, the Legal Representative (or authorized person) uses a level 2 electronic identification account to log in to the VNeID Application, provide information and send a request for an account for the enterprise.

In case the legal representative is a Vietnamese citizen, register for level 2 identification according to Article 10 of Decree 69/2024/ND-CP.

In case the legal representative is a foreigner, register for level 2 identification according to Article 11 of Decree 69/2024/ND-CP.

2. Is there a fee to apply for an electronic identification account?

According to Article 27 of Decree 69/2024/ND-CP, the cost of registering for electronic identification is regulated as follows:

Cost of issuing and using electronic identification accounts and using electronic authentication services

  • Electronic identity subjects are agencies, organizations, Vietnamese citizens, and foreigners who do not have to pay the cost of registering for an electronic identification account created by the electronic identification and authentication system and the cost of using their electronic identification account in electronic transactions.
  • Organizations and individuals exploiting electronic authentication services shall pay fees to organizations providing electronic authentication services in accordance with the provisions of law on prices.
  • State agencies, political organizations, and socio-political organizations shall not have to pay fees when using electronic authentication services.

Thus, fees will be exempted when registering for an electronic identification account.
