Regulations on periodic health check-ups for employees in 2026
As 2026 enters its final months, periodic health checks are not only an employee welfare requirement but also a compliance matter that businesses should proactively review.
Under current regulations, employers are responsible for organizing annual periodic health examinations for their employees. While the regulations do not specify a particular deadline for completing these examinations, local authorities have recently issued official notices to businesses and organizations operating within their respective jurisdictions regarding the deadline for completing the 2026 health examinations.
1. Periodic Health Check Requirements and Key 2026 Deadlines
Under Article 21 of the Law on Occupational Safety and Hygiene No. 84/2015/QH13, employers are required to organize health checks for employees at least once a year. Employees performing heavy, hazardous or dangerous work, as well as employees with disabilities, under 18 or elderly employees, must undergo health checks at least every six months. Female employees are also subject to gynecological examinations as prescribed.
Although the general requirement is to conduct health checks at least once a year, with no single deadline applicable to all employers, local authorities may set specific timelines for completion and/or data reporting. In 2026, employers in Hanoi and Ho Chi Minh City should note the following:
Hanoi
Under Official Letter No. 6347/SNV-VLATLĐ dated 21 August 2026, entities that have not completed the required health checks should urgently arrange and complete the periodic health checks before November 2026
Ho Chi Minh City
Under Official Letter No. 16093/SNV-VLATLĐ dated 17 August 2026, employers must ensure that 100% of employees complete their periodic health checks before 31 October 2026, with the results updated within three days after completion.
2. Penalties for Non-Compliance
Under Decree No. 283/2026/NĐ-CP, employers that fail to organize periodic health checks as required may be fined VND 2–6 million for each employee in violation, up to VND 150 million for an organization, and may also be required to arrange the required health checks.
3. Recommended Action
Employers should arrange the required health checks and complete the relevant data updates as early as possible, particularly where the 2026 plan has not yet been completed, to meet applicable local deadlines and minimize compliance risks.
